Tim Swickard and Hillary Booth obtained significant modifications to the reporting requirements contained in the California Air Resources Board’s Airborne Toxic Control Measure for our client, a company that warehouses and transports refrigerated goods throughout the country. This Measure, which will be in full effect at the end of 2008, applies to all Transport Refrigeration Units on trucks, trailers, shipping containers, and railcars operating in California, whether they are registered in California or elsewhere. Under the standard reporting requirements, our client faced weeks of preparing documents for disclosure. The modifications we achieved allowed the client to remain in compliance with the Measure, but, at the same time, avoid some of its expensive and rigorous reporting requirements.
